Important: Passport for minor children

The parents of minor children are hereby informed that starting from June 14, 2023, it will no longer be necessary to present the consent document of the other parent for the issuance of their own identity document (passport and ID card), pursuant to Decree Law 69/2023.
Specifically, the amended Article 3-bis of Law 1185/1967 states that when there is a concrete and current danger that, due to the transfer abroad, one parent may evade their obligations towards the children, the other parent may request an injunction against the issuance of the document.
The request can be submitted to the competent judge at the ordinary court where the child has their habitual residence or, if the child is residing abroad, to the court in whose jurisdiction their AIRE (Registry of Italians Residing Abroad) municipality is located.
For the issuance of documents for minors, however, the requirement of consent signed by both parents or the person exercising parental responsibility remains in place.
